One of the hot topics in Turkey is protection of IP rights in all aspects. Although the Supreme Court has cancelled some articles of the Trademark law relevant to the criminal sanctions, execution of legal rights is much more practical when compared to other legal disputes. Enforcement of IP rights is relatively new in Turkish law. Considering that Turkey has adopted the Civil/Roman law beginning from 1923, legal texts for protection of IP rights are new. Even though first patent law was in force in 1871 and first trademark regulation was in force since 1879, these regulations could never be very actively enforced.
At the moment there are some problems with the criminal procedure of enforcing patent and industrial designs rights but in the civil aspect of the enforcement the courts seem less reluctant to grant the right owner with effective execution of the rights
